URN.Court records show that the Club entered Villa Park in 1976 with permission from Uganda Railways Corporation -URC as the registered proprietor. The club then developed the land as its training ground and has used it for more than 40 years as a tenant by occupancy of the URC.
The High Court in Kampala has awarded 200 million Shillings to Sports Club Villa for damages suffered as a result of the delayed compensation for the takeover of Villa Park-the Club’s training ground in Nsambya.
Land Division Judge John Eudes Keiterima issued the order this morning on the basis that the Uganda National Roads Authority-UNRA was supposed to pay more than 3 billion Shillings for evicting the club from its training ground in 2019 to pave way for the construction of the Kampala flyover.https://googleads.g.doubleclick.net/pagead/ads?client=ca-pub-1885173889378683&output=html&h=345&adk=1590975256&adf=921249380&pi=t.aa~a.4031299446~i.3~rp.1&w=414&lmt=1658491428&num_ads=1&rafmt=1&armr=3&sem=mc&pwprc=9833304535&psa=1&ad_type=text_image&format=414×345&url=https%3A%2F%2Fugandaradionetwork.net%2Fstory%2Fsports-club-villa-awarded-ugx-200m-over-delayed-compensation-&fwr=1&pra=3&rh=320&rw=384&rpe=1&resp_fmts=3&sfro=1&wgl=1&fa=27&dt=1658491428290&bpp=2&bdt=813&idt=-M&shv=r20220721&mjsv=m202207180101&ptt=9&saldr=aa&abxe=1&cookie=ID%3Df673dcf29e716676-22fa0ff5cfcd00e5%3AT%3D1658146801%3ART%3D1658146801%3AS%3DALNI_MYMCHLIWk3Ke0xT8tP2Mkp0uYlm-Q&gpic=UID%3D00000789c2467025%3AT%3D1658249344%3ART%3D1658489899%3AS%3DALNI_MY1wp3-NQOlvPPnvS61C9Acl6YyJA&prev_fmts=384×1417%2C414x345%2C414x345%2C0x0%2C414x345&nras=3&correlator=744223914531&frm=20&pv=1&ga_vid=394590582.1657529785&ga_sid=1658491428&ga_hid=1563595579&ga_fc=1&u_tz=180&u_his=6&u_h=896&u_w=414&u_ah=896&u_aw=414&u_cd=32&u_sd=2&adx=0&ady=1607&biw=414&bih=715&scr_x=0&scr_y=0&eid=44759876%2C44759927%2C44759842%2C44763505%2C44766558%2C31060048%2C42531607%2C31062930&oid=2&pvsid=2663618849088773&tmod=2118086300&nvt=1&ref=https%3A%2F%2Fugandaradionetwork.net%2Fa%2Farchive.php%3FstatusId%3D4%26message%5B%5D%3D5%26message%5B%5D%3D5%26message%5B%5D%3D5%26message%5B%5D%3D5%26message%5B%5D%3D5%26message%5B%5D%3D5&eae=0&fc=384&brdim=0%2C0%2C0%2C0%2C414%2C0%2C414%2C896%2C414%2C715&vis=1&rsz=%7C%7Cs%7C&abl=NS&fu=128&bc=31&ifi=6&uci=a!6&btvi=4&fsb=1&xpc=HddnebmODl&p=https%3A//ugandaradionetwork.net&dtd=16
Court records show that the Club entered Villa Park in 1976 with permission from Uganda Railways Corporation -URC as the registered proprietor. The club then developed the land as its training ground and has used it for more than 40 years as a tenant by occupancy of the URC.
However, on July 19, 2019, UNRA asked Sports Club Villa to vacate the land and subsequently deployed security personnel to forcefully evacuate part of the Club’s training ground and offices. But as the UNRA grader started razing the structures, Uganda Railways Corporation presented a court order, stopping any developments in the park.
On the basis of the disruption that also resulted in the destruction of property, the club filed a case indicating that it had suffered inconvenience and embarrassment for which it should be paid damages. But UNRA told the court that the Club’s property was not among those that were to be affected, in the process of land acquisition for the Kampala flyover project.
UNRA, however, argued that Uganda Railways Corporation, which owned eight acres of the expropriated land, couldn’t be compensated because there were multiple claims over the same. Consequently, UNRA sued Uganda Railways Corporation for blocking the project. https://googleads.g.doubleclick.net/pagead/ads?client=ca-pub-1885173889378683&output=html&h=345&adk=1590975256&adf=3638889734&pi=t.aa~a.4031299446~i.15~rp.1&w=414&lmt=1658491428&num_ads=1&rafmt=1&armr=3&sem=mc&pwprc=9833304535&psa=1&ad_type=text_image&format=414×345&url=https%3A%2F%2Fugandaradionetwork.net%2Fstory%2Fsports-club-villa-awarded-ugx-200m-over-delayed-compensation-&fwr=1&pra=3&rh=320&rw=384&rpe=1&resp_fmts=3&sfro=1&wgl=1&fa=27&dt=1658491428290&bpp=2&bdt=813&idt=2&shv=r20220721&mjsv=m202207180101&ptt=9&saldr=aa&abxe=1&cookie=ID%3Df673dcf29e716676-22fa0ff5cfcd00e5%3AT%3D1658146801%3ART%3D1658146801%3AS%3DALNI_MYMCHLIWk3Ke0xT8tP2Mkp0uYlm-Q&gpic=UID%3D00000789c2467025%3AT%3D1658249344%3ART%3D1658489899%3AS%3DALNI_MY1wp3-NQOlvPPnvS61C9Acl6YyJA&prev_fmts=384×1417%2C414x345%2C414x345%2C0x0%2C414x345%2C414x345&nras=4&correlator=744223914531&frm=20&pv=1&ga_vid=394590582.1657529785&ga_sid=1658491428&ga_hid=1563595579&ga_fc=1&u_tz=180&u_his=6&u_h=896&u_w=414&u_ah=896&u_aw=414&u_cd=32&u_sd=2&adx=0&ady=2720&biw=414&bih=715&scr_x=0&scr_y=0&eid=44759876%2C44759927%2C44759842%2C44763505%2C44766558%2C31060048%2C42531607%2C31062930&oid=2&pvsid=2663618849088773&tmod=2118086300&nvt=1&ref=https%3A%2F%2Fugandaradionetwork.net%2Fa%2Farchive.php%3FstatusId%3D4%26message%5B%5D%3D5%26message%5B%5D%3D5%26message%5B%5D%3D5%26message%5B%5D%3D5%26message%5B%5D%3D5%26message%5B%5D%3D5&eae=0&fc=384&brdim=0%2C0%2C0%2C0%2C414%2C0%2C414%2C896%2C414%2C715&vis=1&rsz=%7C%7Cs%7C&abl=NS&fu=128&bc=31&ifi=7&uci=a!7&btvi=5&fsb=1&xpc=stl4ruevQ6&p=https%3A//ugandaradionetwork.net&dtd=19
The Court allowed the application and directed UNRA to deposit 7.5 billion Shillings for compensation ahead of the eviction and commencement of its construction process. UNRA subsequently argued that it could pay Sports Club Villa for the land because the money had already been deposited with the Court.
However, Land Division Judge Keiterima has ruled that in another case, filed by UNRA against eight respondents, a consent order was made that Sports Club Villa be paid compensation in accordance with the Chief Government valuers report which had estimated the value of the Club’s land to be 3.2 billion Shillings. According to Keiterima, the consent order has never been set aside.
“The said amount of money had been ordered to be deposited in court but it has not been deposited to date. It is therefore because of the delayed compensation and yet the plaintiff’s land was expropriated by the defendant to construct a flyover that I will award the plaintiff 200m as general damages,” he said.
Keiterima has also awarded interest of 10 per cent per annum from July 26, 2019, when the land was expropriated until the monies are paid in full. UNRA will also pay the costs of the suit to Sports Club Villa.
