At least 600 Bibanja holders at Yala- Kasambya Village in Kiganda Sub County in Kassanda District, have amicably resolved the dispute with their landlord Sister Mary Richard Nayiga from St. Joseph’s Society over 627-acres of land.
The parties have been embroiled in protracted legal battles in the courts of law with the former challenging eviction from their pieces of land. However, during a meeting held at Yala Primary School, the parties signed an agreement allowing Sister Nayiga to survey and open the boundaries of the entire land and allow them to retain their portions of land.
Under the arrangement, Sister Nayiga and her organization will take and utilize partof the vacant land. Those who signed the agreement include residents and their lawyer Ainebyona Tebalina Musango, Kassanda district officials, the Member of Parliament for Kassanda South, Frank Kabuye as well as Ssesanga Gonzaga Kironde and Ms Evelyn Zawedde who represented Sister Nayiga.
The residents described the agreement as a huge milestone, saying that they didn’t know where to go upon eviction. Julius Lwoga, 75, who sits on a 9-acre kibanja described the agreement as confirmation that he will not be evicted.
The resident’s Lawyer Ainebyona Tebalina Musango, said that they agreed that every kibanja holder will receive a title to confirm their occupancy and that Sister Nayiga will utilize the remaining land.
Sister Nayiga’s lawyer Ssekandi said that his client has no intention ofevicting anybody from the land but they are only opening the boundaries to ascertain the size of her land and provide the occupants with titles.
Kassanda District Vice Chairperson, Derrick Sembuusi Ssemugabi advised the residents to always understand their landlord and legalise their stay. He is optimistic that the agreement will yield benefits for the residents.
Kassanda South MP, Frank Kabuye asked the landlords to always follow the laid down procedures, which give the occupants first priority to buy the land they occupy.
